ROCKEL SHIPPING COMPANY LIMITED

FREIGHT SHIPPING TERMS AND CONDITIONS

 

1.      ACCEPTANCE OF TERMS

a.      By engaging in business with Rockel Shipping Company Limited ("Rockel Shipping" or "the Company"), you agree to be bound by these Terms and Conditions. These terms govern the shipping services provided by Rockel Shipping for cargo transportation.

b.      All contracts of shipment are made in the UK and shall be governed by English Law in the UK. Any dispute arising out of any act or contract to which these conditions apply shall be subject to the exclusive jurisdiction of the English Courts in the UK. All business transacted under our standard conditions as stated above.

c.      The Contract will be between you (the Customer) and us (Rockel Shipping Company Limited). It will not be for the benefit of anyone else (a “Third Party”). You agree and acknowledge that no one else but you and us can enforce the terms of the Contract.

d.      It is important that you fully understand your responsibilities to us before committing to purchasing your order with us. By placing your order, you are confirming that you fully understand and accept the terms of our Contract, your responsibilities to us, and agree that any issues that might arise will be governed by the terms of our Contract. If there is anything you do not understand, you should not commit to your purchase and you should seek independent legal advice. This does not affect your rights as a consumer.

e.      A shipment may be carried via any intermediate stopping places that Rockel Shipping deems appropriate. Rockel Shipping may engage sub-contractors to perform services and contracts both on its own behalf and on behalf of its employees, agents and sub- contractors each of whom shall have the benefit of these terms.

 

2.      SERVICES PROVIDED

 

a.      Rockel Shipping offers sea freight shipping services for various types of cargo from the United Kingdom to Sierra Leone and other destinations. Our services include but are not limited to cargo handling, documentation, customs clearance, and transportation.

b.      Rockel Shipping reserves the right in its absolute discretion to refuse carriage to any shipment tendered to it for transportation.

c.      Dates given to customers must be regarded as Expected dates, Expected closing date, Expected Time of Sailing (ETS), Expected time of Arrival (ETA) and Expected clearing dates. These are dates given by the main shipping lines and they cannot be guaranteed by them therefore Rockel Shipping cannot guarantee customers that these dates will be definite. By using Rockel Shipping’s services you agree Rockel Shipping cannot guarantee arrival date and therefore cannot be held liable for any harm caused by delays to shipments.

 

d.      Rockel Shipping is a shipping company and therefore does not store goods. Goods not paid for completely and therefore not shipped within two weeks of collection by us or delivery by yourself or your agent can be disposed without any notice being given.

 

e.      In the event of your goods being shipped to Freetown without full payment, again your goods can be disposed of two weeks after the goods arrive in Freetown without notice.

 

f.       Goods shipped to Freetown, whether paid for or not will only be stored for two weeks from the date of arrival in Freetown at the discretion of Rockel Shipping. After the two weeks period, your goods will be disposed of without further notice.

 

g.      Should Rockel Shipping decide to store your goods a daily storage fee of £5 (GBP) per day will be applied from the 7th day of the arrival of your shipment.

 

h.      CUSTOMS IN SIERRA LEONE, THE UK AND OTHER COUNTRIES HAVE THE RIGHT TO OPEN CONTAINERS AND PACKAGES TO CONDUCT RANDOM CHECKS FOR COMPLIANCE AND LEGALITY. ROCKEL SHIPPING STAFF WILL ENDEAVOUR TO BE PRESENT AND RECORD INSPECTIONS.

 

i.       ROCKEL SHIPPING COMPANY STAFF AND CHOSEN AGENTS ALSO HAVE THE RIGHT TO OPEN CONTAINERS AND PACKAGES TO CONDUCT RANDOM CHECKS FOR COMPLIANCE, LEGALITY AND SAFETY. ROCKEL SHIPPING STAFF WILL ENDEAVOUR TO RECORD INSPECTIONS.

 

 

j.       Rockel Shipping DOES NOT offer insurance services of any kind, you (the Customer) are responsible for insuring your shipment for the entirety of the journey. Your payments are for shipping and if stated clearing services only.

 

k.      Freetown is classified as a high risk country therefore Rockel is unable to insure items shipped by customers to Freetown.

 

l.       Customers must make their own personal arrangements to take out an all risk insurance policy if desired.

 

m.    Other services may be agreed upon between Rockel Shipping and the customer in writing.

 

 

3.      BOOKINGS, COLLECTIONS (UK), DELIVERIES (UK) AND PAYMENT**

 

a.      To initiate a shipment, customers must submit a booking request to Rockel Shipping. Bookings can be made through a request on our online platform or by contacting our customer service by telephone.

b.      Rockel will make every effort to maintain appointment times this will not always be accurate.

c.      We will collect items for shipment from venues identified by yourself at an agreed fee starting FROM £30.00 per collection within the M25 radius. For areas outside this radius please ring 020 8595 6688.

d.      If the collection address has stairs higher than 2 floors (without a working lift) the following may apply;

e.      You may need to bring all items to the ground floor.

f.       Packing may have to be done inside the van.

g.      You may be charged extra.

h.      Service may be declined without refund of the fee.

i.       Overweight items maybe declined for shipment.

j.       All fridge and Freezers must not be packed prior to us arriving as weight restriction may apply for health and safety lifting regulations for the staff. These will have to be packed when the fridge or freezer has been loaded empty in the van. Highly loaded fridges and fridge-freezers are at high risk of damage.

k.      We can provide you with various sizes of cardboard boxes within the shipping fees. All other types of containers used for packing your items will be at a cost if provided by Rockel Shipping Company. You are welcome to source the packaging of your choosing.

l.       We assist in packing items at the collection point and offer advice where possible and necessary. Final responsibility for the securing and checking of items before shipment lies with the customer. This includes but is not limited to taping, securing, locks for drums etc. Rockel will not be responsible for issues that arise from goods not locked, secured and protected properly.

m.    Anything delivered to Rockel Shipping that needs to be packed, repackaged or secured will attract an additional packing fee, depending on the level of packing (minimum £10).

n.      All Goods must be paid for at the time of collection or delivery including the collection charges.

 

 

o.      Payment for shipping services must be made in accordance with the terms specified in these terms. Failure to make timely payments may result in delays or additional charges.

p.      Prices vary according to the size of the container used for shipment.

q.      Customers will be given the exact cost at the time of collection, delivery or as soon as reasonably possible.  Estimates can be obtained by the customer by providing Rockel Shipping with the dimensions (length, height and width) of the items. Estimates are not final until Rockel Shipping has verified.

r.       Customers wishing to deliver or do their packing at the Rockel Shipping warehouse will be given a price at that point or as soon as reasonably possible. If packing is needed a minimum fee of £10 will be charged.

s.       Customers wishing to ship vehicles are advised to ring the office for a quotation. For all vehicles customers are advised to measure the width, length and height (and weight for larger vehicles) so calculations could be made before a quotation is given.

t.       All quotations given for vehicles remain an estimate until confirmation of true size have been received from the Shipping Lines.

 

u.     Payment Options

                                                        i.      Payments could be made by cash, card at collection or over the phone or bank transfer.

                                                      ii.      All payment must be made at the time of collection (if we come to collect from your identified venue), delivery (if you deliver your items to our warehouse) or come in to our warehouse to pack your items.

                                                    iii.      Items not paid for as per item 2 are not likely to be shipped.

                                                    iv.      Any payments must be made at least 2 days prior to the container closing date.

 

4.      LIABILITY

a.      Your payment is for freight is for payment only. By shipping with Rockel Shipping, you accept that Rockel Shipping has no liability in the event of loss or damage.

 

5.      SHIPPING DOCUMENTS

 

a.      Rockel Shipping will provide the necessary shipping documents, including but not limited to the bill of lading, packing list, and commercial invoice where relevant. It is the responsibility of the shipper to provide accurate and complete documentation and required information.

 

6.      CUSTOMS CLEARANCE

 

a.      We will clear your items through customs (Excluding any form of vehicles or whole containers).

 

b.      For shipments excluded from Rockel Shipping’s clearing policy, Rockel Shipping will assist in customs clearance procedures; however, it is the shipper's responsibility to ensure that all customs documentation is accurate and complete.

 

c.      The customer/ recipient is responsible for any customs duties, taxes, or fees imposed by the authorities in the UK, Sierra Leone and other destinations; unless other arrangements are agreed in writing.

 

7.      RECEIPT & DELIVERY

 

a.      Rockel Shipping will use reasonable efforts to ensure timely and secure delivery of the cargo to the agreed-upon destination. Delays caused by factors beyond the control of Rockel Shipping, such as weather conditions, payment delays, shipping line delay, port congestion, or customs procedures, are not the responsibility of the Company.

b.      Rockel Shipping does not deliver items. We can facilitate third party delivery upon request.

c.      It is the duty of the customer to make arrangements with their personal agents/recipient at the destination for them to collect the shipment at Rockel Shipping Company's Freetown Office.

 

d.      Customer's agents in Freetown will be required to check that boxes and other containers used for shipment are sealed. They will also be required to check individual items are secured before signing to receive shipment.

 

e.      Any discrepancy or damage to shipment must be reported by the customer's agents to Rockel Shipping Freetown Office before signing receipt of goods. This will be recorded by Rockel Shipping Freetown Office and communicated with the London Office. Complaints of missing items after collection of a sealed box, drum or other form of packaging will not be addressed by Rockel Shipping and we will bear no responsibility for this.

 

f.       Queries on items that have been received and signed for in Freetown by customer's Freetown agents will not be addressed.

 

 

8.      CLAIMS & COMPLAINTS

9.      FORCE MAJEURE

 

a.      Rockel Shipping shall not be liable for any failure or delay in performing its obligations under these terms if such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, wars, strikes, natural disasters, or government actions.

 

10.  GOVERNING LAW

 

a.      These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

 

b.      By engaging in business with Rockel Shipping Company Limited, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Rockel Shipping reserves the right to update or modify these terms at its discretion.
